Driving Under The Influence
California has two separate procedures for DUI cases that run simultaneously. When you are arrested under the suspicion of driving under the influence, criminal charges may be filed against you. The criminal charges are handled in the Superior Court and your initial appearance is called an Arraignment. In addition to any criminal charges, you are subject to an Administrative Per Se (APS) review conducted by the DMV. This means that your license may be automatically suspended by the DMV for four months for a first offense unless you request an administrative hearing within the first 10 days after your arrest. You must request an administrative hearing within 10 days of being arrested. DUI Penalties
